Checking compliance with restrictions on hazardous substances in products, tattoo inks and permanent make-up

The ECHA Executive Board has agreed to an EU-wide enforcement project focusing on restrictions on hazardous substances in products. Another project will examine restricted substances in tattoo inks and permanent make-up.

As part of the upcoming enforcement project (REF-16), inspectors will check whether products or mixtures placed on the market comply with the restrictions set out in the EU Chemicals Regulation. This will include verifying that the restricted hazardous substances in products are below the permitted levels.

The aim of the project is to improve the targeting of controls to better identify non-compliant products. Inspectors will also include online sales in their inspections. The Board will work with the European Commission and national authorities to examine how inspection results from online sales can support the enforcement of the requirements applicable to online platforms under the Digital Services Act. Inspections are planned for 2028, with a report expected in 2029.

The association also agreed to launch a new pilot project on tattoo inks and permanent make-up. Inspectors will check whether these products comply with the restrictions, focusing on the presence of hazardous substances above permitted thresholds and correct labelling. Inspections are due to start in 2027 and the report will be published in 2028.
